This unit considers the nature of justice for Indigenous people with a particular emphasis on Aboriginal and Torres Strait Islander people in Australia. The unit investigates the nature and causes of differential justice outcomes for Indigenous people across both civil and criminal law. While the unit necessarily considers negative features of the legal system that affect Indigenous people, particular emphasis is given to positive aspects of Indigenous empowerment to use traditional knowledge and culture to provide positive justice outcomes. The unit is designed to ensure that students understand and appreciate Indigenous community protocols to be able to work in culturally respectful and appropriate ways.
1. Critically reflect on Indigenous and non-Indigenous perspectives on the nature of justice for Indigenous people and communities;
2. Critically evaluate laws, policies, and practices impacting Indigenous people and communities;
3. Demonstrate knowledge of Indigenous community protocols and the major issues and strategies relevant to working effectively in Indigenous contexts; and
4. Appreciate the value of Indigenous ways of knowing and doing in developing justice discourse generally.
