Citation

1.
This Statute may be cited as the University Facilities Statute 1992.

Repeal

2.
The Facilities Statute (Statute No. 29 of the Canberra College of Advanced Education) and the Facilities Amendment Statute 1983 (Statute No. 51 of the Canberra College of Advanced Education) are repealed.

Definitions

3.
In this Statute, unless the contrary intention appears:

"prescribed facility" means a facility of the University specified in the Schedule.

Rules relating to facilities

4. (1)
The Council may make rules, not inconsistent with the Act or a Statute, with respect to the management, good government and discipline of a prescribed facility.
(2)
In particular, without affecting the generality of the last preceding subsection, the Council may make rules:
(a)
regulating access to, and conduct in, a prescribed facility; and
(b)
regulating the conditions under which a person may borrow, hire, have access to or use articles normally held in a prescribed facility or may operate or use equipment, exercise privileges, or use services, of such a facility; and
(c)
making provision in relation to the payment to the University of compensation for loss of or damage to articles so borrowed, hired, accessed or used or equipment so operated or used; and
(d)
as set out in subsection 5(3).

Contravention of rules

5. (1)
A person must not contravene a provision of the rules made under this Statute that is applicable to the person or a provision of a determination made under those rules.
(2)
Without limiting the generality of the last preceding subsection, a person who borrows or hires an article normally held in a prescribed facility must not keep the article beyond the period for which he or she was permitted to borrow or hire the article.
(3)
The Council may make rules in relation to the imposition of penalties for a breach of this section.

Saving

6. (1)
Any rules made under the Facilities Statute (Statute No. 29 of the Canberra College of Advanced Education) and in force immediately before the coming into operation of this Statute continue in force as if the Facilities Statute had not been repealed but rules so continued in force may be amended or repealed by rules made under this Statute.
(2)
In any rules continued in force under subsection (1), unless the contrary intention appears:
(a)
a reference to a book includes a reference to a periodical, newspaper, film, sound recording, musical score, map, plan, picture, photograph and print; and
(b)
a reference to the Library is a reference to the Library of the University and includes any facilities of the University under the control of the Librarian.
(3)
Subsection (2) has effect subject to any rules made under this Statute amending the rules continued in force under subsection (1).
