Citation
- 1.
- This Statute may be cited as the Traffic Statute 1995.
Repeal
- 2.
- The Traffic Statute (Statute No 16 of the Canberra College of Advanced Education) is repealed.
Definitions
- 3.
- In this Statute, unless the contrary intention appears:
- "loading zone" means any area of University land declared to be a loading zone under section 5;
- "Motor Traffic Act" means the Motor Traffic Act 1936 of the Australian Capital Territory;
- "parking area" means any area of University land declared to be a parking area under section 5;
- "road" means a street, road, lane or path situated on University land;
- "Traffic Officer" means the Traffic Officer appointed under section 4;
- "Traffic Warden" means a Traffic Warden appointed under section 6;
- "University land" means land occupied by the University in the Australian Capital Territory.
Appointment of Traffic Officer
- 4.
- The Council may, by resolution, appoint an officer of the University to be the Traffic Officer for the purposes of this Statute.
Parking areas and loading zones
- 5. (1)
- The Council may, by resolution, declare any area of University land specified in the declaration to be a parking area for the purposes of this Statute.
- (2)

The Council may, by resolution, declare any area of University land specified in the declaration to be a loading zone for the purposes of this Statute either:
- (a)
- at all times; or
- (b)
- within particular times that are to be indicated on a sign relating to the area.
Appointment of Traffic Wardens
- 6.
- The Traffic Officer may, by instrument in writing, appoint members of the staff of the University to be Traffic Wardens for the purposes of this Statute.
Driving, stopping and parking of vehicles of University land - prohibition
- 7.

Except with the permission of the Traffic Officer, a person must not, without lawful excuse, drive, stop or park a vehicle on any University land other than:
- (a)
- the carriageway of a road; or
- (b)
- a parking area; or
- (c)
- a loading zone.
Removal of vehicles
- 8.
- If requested to do so by a Traffic Warden, a person who has been driving a vehicle on University land [or whose vehicle has been stopped or parked on University land] must remove the vehicle from University land.
Application of Motor Traffic Act
- 9. (1)
- Subject to this Statute, the relevant provisions of the Motor Traffic Act are to apply to University land as if those provisions were sections of this Statute.

In this section, "relevant provisions of the Motor Traffic Act" means the following provisions of that Act:
- (a)
- PART I - PRELIMINARY, including section 4 - Interpretation;
- (b)
- PART VII - TRAFFIC SIGNS AND ROAD MARKINGS
- (c)
- PART VIII - RULES OF THE ROAD
- (d)
- PART IX - SPEED LIMITS
- (e)
- PART X - RULES RELATING TO PARKING
- (f)
- sections 167, 171-176 (inclusive), 178 and 180 of PART XI - OFFENCES
- (g)
- PART XIA - TRAFFIC INFRINGEMENTS
- (h)
- PART XII - EQUIPMENT AND LOADS
- (i)
- PART XIII - PENALTIES.

The relevant provisions of the Motor Traffic Act that, under subsection (1), apply to University land apply as if:
- (a)
- a reference in those provisions to an inspector were read as a reference to a Traffic Warden; and
- (b)
- a reference in those provisions to an off-street parking area were read as a reference to a parking area; and
- (c)
- a reference in those provisions to a public place were read as a reference to a parking area; and
- (d)
- a reference in those provisions to a public street were read as a reference to a road; and
- (e)
- a reference in those provisions to a Minister were read as a reference to the Traffic Officer.
