Citation

1. These Rules may be cited as the University of Canberra Academic Progress Rules 2009.

Commencement

2. These rules commence on 1 January 2010.

Revocation

3. The Academic Progress Rules 1995 are revoked.

Definitions

4. (1) In these rules, unless a contrary intention appears:
“appropriate Faculty Board", in relation to a course or unit, means the Faculty Board for the faculty within which the course or unit is being taken.

“course convener", in relation to an offering of a course of study provided by the University, means the member of the University academic staff appointed by the appropriate Faculty Board to coordinate that offering.

“course requirements", in relation to a course of study provided by the University, means the matters entered into the Register of Courses that a student admitted to the course is required to complete successfully in order to qualify for the grant of an award of the University.

“progression review period”, in relation to a course of study provided by the University, means a period of time pre-determined by Academic Board that includes one or more teaching periods.

“teaching period”, in relation to an offering of a course of study, means a semester or a term, whichever corresponds to the way in which the offering is organised.

(2) A Faculty Board or other committee is to exercise its powers under these Rules in accordance with guidelines determined by the Academic Board.

Review of Academic Progress

5. (1) An appropriate review authority may, at any time, review the academic progress made by a student in a course of study or a unit of such a course.

(2) If an appropriate review authority:

(a) reviews a student’s academic progress under subrule 1; and
(b) is of the opinion that the student has not met the criteria for academic progress under subrule (3);

the authority may, by written notice to the student, place the student on academic probation.

(3) A student who has:

(a) failed more than half the total credit point value of the units attempted in a progression review period; or
(b) failed any unit, having previously failed the same unit or the equivalent unit; or
(c) failed to follow either the approved course requirements or a written course variation provided by the course convener and approved by the appropriate Faculty Board;

has not met the criteria for academic progress.

(4) A student who has been placed on academic probation is permitted to continue their course of study for the teaching period following the progression review period in which the student did not meet the criteria for academic progress, subject to conditions specified by the appropriate review authority under subrule (5).

(5) When placing a student on academic probation, the appropriate review authority must impose one or more of the following conditions on the student:

(a) the student must not fail more than half the credit point value of the units attempted in the teaching period following the progression review period in which the student did not meet the criteria for academic progress;
(b) the student must not fail more than half the credit point value of the units in the year following the progression review period in which the student did not meet the criteria for academic progress;
(c) the student must pass a specified unit or units in their course of study teaching period following the progression review period in which the student did not meet the criteria for academic progress;
(d) the student must pass a specified unit or units in the year following the progression review period in which the student did not meet the criteria for academic progress;
(e) the student must not fail again the unit or the equivalent unit identified under subrule 5.(3)(b).

Directions following review

6. (1) If:

(a) a student has been placed on academic probation; and
(b) the teaching period or the year specified in the conditions of continuation imposed under subrule 5(5) has expired; and
(c) the student has not satisfied the conditions so imposed;
the authority may:
(d) direct that the student must not continue with the course of study or the unit, as the case may be, in relation to which the notice was given; or
(e) direct that the student must not, whilst the direction remains in force, take any examination in a unit of that course of study or that unit, as the case may be; or
(f) direct that the student must not, while the direction remains in force, undertake a unit specified in the direction; or
(g) direct that, whilst the direction remains in force, the student must not continue with, or undertake, a course of study, or a unit in a course of study, except in accordance with the conditions specified in the direction.

(2) A direction given under subrule (1) remains in force until the direction is revoked by the appropriate review authority that gave the direction.

(3) Whilst a direction under subrule (1) is in force, the person to whom the direction relates is not entitled to continue with a course of study or take or continue to take a unit of a course of study or take an examination in contravention of the direction.

(4) For the purpose of subrule (1), a notice that is sent by post to a student at a place shown in the records of the University as the student's place of residence is taken to have been given to the student on the date on which the notice would, in the ordinary course of post, have been delivered to that place.

Review by Academic Board

7. If the appropriate review authority that makes a decision to take action under these Rules in relation to a student is either:

(a) an appropriate Faculty Board; or
(b) a committee referred to in paragraph 4(c) of the Academic Progress Statute 1995;

the Academic Board may review the decision made by that review authority.
